General Conditions of Sale and Delivery

Revitaqua Systems

These General Conditions of Sale and Delivery govern the supply of Revitaqua devices and related equipment by the manufacturer or its authorized representatives, unless otherwise expressly agreed in writing.

1. Scope of Application

All offers, quotations, and sales of Revitaqua devices are made exclusively on the basis of these conditions. Any differing or additional terms proposed by the purchaser shall apply only if expressly accepted in writing by the seller.

The information presented on this website is for general informational purposes only and does not constitute an offer to sell or a binding commercial proposal.

2. Formation of Contract

A contract of sale is concluded only upon written confirmation of an order or issuance of an invoice by the seller. Technical descriptions, specifications, and illustrations are indicative and may be subject to reasonable modification in the course of product improvement.

3. Prices and Payment

Unless otherwise stated, prices are quoted ex works (EXW) Budapest, Hungary, in accordance with Incoterms® as published by the International Chamber of Commerce.

Payment terms are specified in the invoice or written agreement. Ownership of the goods remains with the seller until full payment has been received.

4. Delivery and Transfer of Risk

Delivery is deemed to occur when the goods are made available to the purchaser or to a carrier at the seller’s premises, unless otherwise agreed in writing.

Risk of loss or damage transfers to the purchaser at the moment the goods are handed over to the carrier or collected by or on behalf of the purchaser.

If the seller assists in arranging transport, such assistance is provided solely as a service to the purchaser and does not alter the transfer of risk unless explicitly agreed in writing.

The purchaser is responsible for arranging transport insurance unless otherwise agreed.

5. Inspection and Transport Damage

The purchaser must inspect the goods immediately upon receipt.

Any visible transport damage must be reported directly to the carrier at the time of delivery and documented in the carrier’s delivery record. Failure to do so may limit the purchaser’s ability to pursue claims against the carrier.

Transport damage occurring after delivery or during onward shipment arranged by the purchaser or third parties is not the responsibility of the seller.

6. Warranty

The seller warrants that the delivered equipment is free from defects in materials and workmanship under normal and intended use for a period specified in the product documentation or sales agreement.

The warranty covers repair or replacement of defective components at the seller’s discretion. The warranty does not cover:

  • damage resulting from transport after delivery,

  • improper handling, installation, or operation,

  • unauthorized modification or repair,

  • normal wear and tear,

  • damage caused by external mechanical or environmental factors.

The warranty does not include shipping costs, customs duties, or other logistical expenses unless expressly agreed in writing.

7. Returns

Returns of equipment are accepted only with prior written authorization from the seller. Unauthorized returns may be refused.

Equipment returned for inspection or repair must be properly packaged and shipped at the purchaser’s expense unless otherwise agreed.

8. Limitation of Liability

To the extent permitted by applicable law, the seller shall not be liable for indirect or consequential damages, including loss of business, loss of profit, or operational interruption arising from the use or inability to use the equipment.

The seller’s total liability, whether in contract or tort, shall not exceed the purchase price of the equipment in question.

9. Technical and Medical Disclaimer

Revitaqua systems are designed as wellness and health-support devices. They are not intended to diagnose, treat, cure, or prevent disease unless explicitly stated and approved under applicable regulatory frameworks in the relevant jurisdiction.

Users are responsible for ensuring compliance with local regulations regarding installation and use.

10. Governing Law and Jurisdiction

All sales contracts shall be governed by the laws of Hungary, unless otherwise agreed in writing.

Any disputes arising from or in connection with the sale of goods shall be subject to the jurisdiction of the competent courts in Hungary, unless otherwise agreed.

11. Final Provisions

If any provision of these conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
